Title IV Disclosure Obligations: General Provisions Relating to Student Assistance Programs (Program Participation Agreements
 
Title IV requires institutions particpating in financial aid programs to disclose specified information to all prospective students. A list of the disclosure requirements, and links to pages that contain the actual information or where to obtain the information can be found on the CUA consumer information webpage. A chart listing the different requirements under the law and identifying who receives the information (currently enrolled students, current employees, the general public, applicants for admission, etc.); what they receive (the entire report or notice of availablity of report); how it must be provided (direct individual notice, web page, email);  and when (what date, how often) it must be provided is  available as the last three pages of Chapter 7 of the Student Finanical Aid Handbook, which deals with Consumer Information.

26 C.F.R. § 1.501(c)(3)(1)

 

A university that discriminates on the basis of race is in danger of losing its tax exempt status.  Schools are required to publicize their non-discrimination policy, certify annually, and keep records to show compliance.  See Rev. Rul. 71-447, 1971-2 C.B. 230Rev. Proc. 75-50, 1975 -2 C.B. 587, and Rev. Rul. 75-231, 1975-1 C.B.158. The Dean of Admissions is responsible for keeping records (for three years)to show that scholarship and financial aid are awarded on a racially non-discriminatory basis. The Dean of Admissions is also responsible for keeping for 3 years Copies of advertisements/web pages sufficient to indicate when and in what publications CUA advertised for student recruiting.

Age Discrimination Act of 1975

Prohibits discrimination on the basis of age (minimum or maximum) at private institutions that receive federal financial assistance.  The Dean of Admissions is responsible for ensuring there is no age discriminationin admissions.

 
Family Educational Rights to Privacy Act of 1974 (FERPA)  

Summary of the Law: 
 
Regulates the keeping and dissemination of student records at all institutions that receive federal funds or who have students receiving federal funds.  Procedures must be in place to allow a student access to student records.  Consent must be obtained to release student records to a third party, with certain exceptions contained in the law.   
              
Required Action:
The Dean of Admissions oversees FERPA compliance for all student education records under their purview,  as well as for applicant records covered by FERPA.

 


Veteran's Readmission
Effective August 14, 2008, as part of the Higher Education Opportunity Act of 2008, schools are required to readmit students who left in order to join the military. See the NAICU HEA Quick Guide for statutory language and  other resources.  

Required Action: The Dean of Admissions has the responsibility to coordinate implementation of this new requirement with individual Schools at the University and to suggest any system implementations that need to be in place.
