Campus Security Act of 1990

Summary of the Law:
This law requires all campus security authorities to report crimes on campus to the Department of Public Safety. CUA's definition of campus security authorities includes all employees of the university who have significant responsibility for student and campus activities, including the dean of students.

Required Action:

Report any crimes to the Department of Public Safety Dispatcher

Family Educational Rights to Privacy Act of 1974 (FERPA)

Summary of the Law:
Regulates the keeping and dissemination of student records at all institutions that receive federal funds or who have students receiving federal funds. Procedures must be in place to allow a student access to student records. Consent must be obtained to release student records to a third party, with certain exceptions contained in the law.

Required Action: 

The responsibility of the Director of Housing is to ensure procedures are in place to protect the confidentiality of all education records maintained and accessed in the office.

Age Discrimination Act of 1975

Prohibits discrimination on the basis of age (minimum or maximum) at private institutions that receive federal financial assistance. The Director of Housing is responsible for ensuring there is no discrimination on the basis of age in housing.

The Rehabilitation Act of 1973 (Section 504)

The Americans with Disabilities Act of 1990

Summary of the disability laws: Title III of the ADA prohibits discrimination on the basis of disability in access to private colleges and universities and contains many of the same provisions as the Rehabilitation Act of 1973 (Section 504). Requires reasonable accommodations (e.g., a modification or adjustment to the status quo inherent in the program or activity) to allow a qualified person with a disability to participate fully in the programs and activities of the university. Participation must be in the most integrated setting possible. The Rehabilitation Act prohibits discrimination on the basis of disability at any federally-funded institution. This covers admissions, recruitment, programs and services. The college's physical facilities must be accessible to persons with disabilities.

Responsibility of Housing Services: Provide reasonable accommodations in housing to students with disabilities. Coordinate/Consult with Director of Disability Support Services and OGC as needed.

Sales and Use Tax

Director of Housing Responsibilities:

  • Students from other schools who are here for less than 90 days need to be charged the sales tax.
  • If the persons renting are attending a university/educational event or and/one that is co-sponsored with the university, DHS is safe in not assessing the sales tax (this is based on past practices of the DC Department of Finance & Revenue).
